Can I get a worldwide patent?

No. A U.S. patent is valid only within the United States. However, foreign patents may be obtained by applying with the patent offices of the foreign countries of choice or filing an "international" (PCT) application.


What is an "International" or "PCT" application?

By filing one international application under the PCT (Patent Cooperation Treaty), you may seek patent protection in a large number of countries simultaneously. This is a centralized filing procedure that allows you to delay for up to 30-months, from the earliest priority date, to process your application in individual countries.


How many countries are members of the PCT?

Currently 100.


Do I need to obtain a U.S. Patent, before applying for foreign patents?

No. However, you need permission at least from the U.S. Patent and Trademark Office, before applying with the foreign patent offices.


Can I market my idea first and then apply for foreign patents?

Most foreign countries require that a patent application be filed before a public disclosure of the invention is made anywhere in the world.
